AN appeal is being made against refusal of planning permission for a development at Bishopsteignton.
Peter Cousens is making the application in respect of alterations to an existing access route, and the creation of a first-floor balcony at Mulberry House, Huntly.
Teignbridge Council argues that the site is within a conservation area, and the garden contains numerous specimen trees of high amenity value.
The development would have a detrimental impact on a mature cedar tree.
But Mr Cousens maintains that a report by an arboriculturist states it would be extremely unlikely that the works would have a negative impact on the tree.
The appeal, which is partly retrospective as some works have already been undertaken, will be decided at an informal hearing at a date and place to be arranged.
