A NEWTON Abbot man has been cleared of sexually assaulting a guest who went back to his home after a boozy night out.
James Braznell was alleged to have carried out a sexual act on a night club customer who had gone to his house to watch a 3am Conor McGregor fight.
The man ended up asleep on the floor after they discovered that they could not see the UFC championship bout because his television did not have the channel.
He alleged that he woke up to find Braznell touching his private parts and was so angry that he kicked a hole in his television when he got up the next day.
Braznell was found not guilty after telling a jury at Exeter Crown Court that the other man had been drunk and under the influence of cocaine.
He told the jury the complainant exposed himself to him in the middle of the night and there was inadvertent contact with his private parts but that he had not touched him intentionally.
Braznell, aged 32, of Church Road, Newton Abbot, denied sexual assault and was found not guilty.
Mr Brian Fitzherbert, prosecuting, said Braznell had been to several pub in Newton Abbot on the night of Saturday October 6, 2018 and ended up in Bar Seven.
He, the complainant, and three friends went back to his shared house to watch the fight but he found he could not do so on his television. One of the others left to watch it elsewhere while the others went to sleep.
Braznell told the jury he was sharing his bed with two others and when he got up in the night he saw the complainant, who was sleeping on the floor, exposing himself.
He said the other man pulled him towards him and there was some contact, which he did not intend or want, and which he stopped immediately.
