A public inquiry into compulsory purchase orders by Devon County Council for land for the proposed Kingskerswell bypass is due to resume at The Passage House Hotel, Hackney, Kingsteignton, on Tuesday.
It is expected to run for another three or four days.
The council has submitted to the Secretary of State for Transport for confirmation of an order to authorise the compulsory purchase of part of land at Kerswell Common.
Side road orders and other supplementary CPOs will also be considered if there are any objections.
At an inquiry in July, inspector Jack Moffett heard supporting evidence from the county council and objectors to the £120million-£130million scheme which would link Penn Inn with Hamelin Way, Torquay, taking traffic away from the centre of Kingskerswell.
The result of that hearing is still awaited.
If given the all clear the county and Torbay councils would have to find some £22million towards the 5.5 kilometres bypass scheme, money that has already been set aside.
There have been strong objections to the proposed road from some residents and the Kingskerswell Alliance.
The alliance has maintained the proposed bypass is the wrong scheme in the wrong place. It said a tidal flow system could be introduced on the A380, with a pedestrian underpass at the major traffic lights bottleneck at Jury's Corner.
