Motor traders in Torbay have been warned they face possible prosecution if they sell vehicles in an unroadworthy condition. Torbay Council has issued the warning after bringing a successful prosecution against a Paignton motor dealer. Alan Kerr Ltd pleaded guilty at Torbay Magistrates' Court last week to supplying an unroadworthy vehicle – a camper van with defective brakes – under the Road Traffic Act. A guilty plea was also entered by the company in relation to a charge under the Consumer Protection from Unfair Trading Regulations for the misleading omission of failing to supply a copy of the MoT advisory note to the consumers, which listed faults with the braking system. The company was fined £2,000 and ordered to pay the council's costs of £2,000. Cllr Robert Excell, executive lead for safer communities and transport, said: 'Torbay Council's Trading Standards team have done a considerable amount of work in recent years advising motor traders on their responsibilities when supplying vehicles. 'Whilst the council is very keen to work closely with traders to ensure they comply with all the legal responsibilities placed on them, this case shows that if there are serious contraventions we are prepared to bring a prosecution.'
