TESCO has won its high court battle to foil Sainsbury's bid to build a supermarket in Dawlish.

But Sainsbury's has vowed to fight on.

Deputy High Court Judge Rabinder Singh QC last week quashed Sainsbury's planning permission and told Teignbridge Council to consider the two applications side by side.

The three parties are now waiting for the written judgement before planning their next moves.

Judge Singh awarded costs against Teignbridge Council and has refused it permission to appeal. The council will now have to go directly to the Court of Appeal if it wishes to take the case further.
